Delete empty directories does not seem to properly check for empty directories

So I saw this while in Picard's log while trying to figure out something else:

      D: 16:17:32,902 file._save_and_rename:413: Not removing empty directory: /Users/trevor/Downloads is a protected directory

So the log implies that Picard thinks ~/Downloads is empty, but isn't deleting it because it is on a protected list.

The thing is, I have a lot of files in the downloads folder. So I'm wondering what criteria Picard uses to determine if the directory is empty? Because there are certainly other music files. Or is this a wording issue that it won't even check to see if it will delete since it is on a protected list?
